Welcome to OUTRANKME™. By accessing our website, placing an order, or purchasing any product from OUTRANKME™, you agree to be bound by the following Terms of Service. Please read them carefully before using our services.
1. General Conditions
OUTRANKME™ provides custom made apparel and accessories designed for veterans, active service members, and supporters of military culture. By using this website, you confirm that you are at least the age of majority in your jurisdiction or have obtained consent from a legal guardian.
We reserve the right to refuse service, cancel orders, or limit access to our website at any time, to the extent permitted by law.
2. Custom Made Products
All OUTRANKME™ products are made to order based on customer selected specifications, including size, design elements, rank insignia, patch placement, text, and other customization options.
Once an order is placed and production has begun, the order is considered final. Customers are solely responsible for reviewing and confirming all customization details prior to completing checkout.
3. Product Descriptions & Variations
We make reasonable efforts to display products accurately. However, slight variations in color, texture, stitching, materials, or appearance may occur due to screen settings, production methods, or material availability.
Such variations are considered normal and do not constitute defects.
4. Pricing & Payment
All prices are listed in $USD unless otherwise stated. Prices are subject to change without notice.
Payment must be successfully processed before production begins. Orders will not enter production until payment is received in full.
5. Order Processing, Shipping & Delivery
Production timelines and shipping estimates provided at checkout are estimates only and are not guaranteed.
OUTRANKME™ is not responsible for delays caused by carriers, customs processing, weather conditions, holidays, or other factors beyond our control.
Risk of loss and ownership transfer to the customer once the order is handed to the shipping carrier.
Customers are responsible for providing accurate shipping information. OUTRANKME is not responsible for delays, losses, or additional costs resulting from incorrect or incomplete addresses.
6. Returns, Refunds & Resolutions
Due to the custom made nature of our products, returns, exchanges, and cancellations are not accepted once production has begun.
In the uncommon event of a verified production or fulfillment error, OUTRANKME™ may, at its sole discretion, review the issue and determine an appropriate resolution. Any resolution offered may be limited to repair, correction, replacement, or store credit.
Refunds are not guaranteed and will only be issued when no other reasonable resolution is available, as determined by OUTRANKME.
7. Military Insignia, Trademarks & Copyrighted Materials
OUTRANKME™ offers customization options inspired by military rank structures, insignia styles, and service related themes. OUTRANKME™ does not claim ownership of any official military insignia, trademarks, emblems, or service marks belonging to the United States Armed Forces or any foreign military organization.
Any references to rank, symbols, or insignia are used for decorative, expressive, or commemorative purposes only and do not imply official endorsement, affiliation, or authorization by any government or military entity.
Customer Representations
By selecting or submitting any customization, the customer represents and warrants that:
They have the legal right, authorization, or permission to use and display the selected insignia, rank, or design
The customization does not infringe upon any copyright, trademark, or intellectual property rights of any third party
The customization complies with all applicable laws, regulations, and policies
OUTRANKME™ does not verify military service, rank eligibility, authorization, or entitlement to display any insignia.
Customer Submitted Content
If a customer submits artwork, logos, insignia, or designs, the customer grants OUTRANKME™ a non exclusive, royalty free license to reproduce, modify, and manufacture the submitted content solely for the purpose of fulfilling the order.
The customer assumes full responsibility for any claims arising from the use of submitted content.
Right to Refuse Production
OUTRANKME™ reserves the right to refuse, modify, or cancel any order that includes content believed to be unlawful, infringing, misleading, or inappropriate, without obligation to provide a refund beyond what is required by law.
8. Intellectual Property
All content on this website, including but not limited to logos, designs, text, images, graphics, and branding, is the property of OUTRANKME™ and is protected by applicable intellectual property laws.
No content may be copied, reproduced, distributed, or used without prior written permission from OUTRANKME™.
9. Limitation of Liability
To the fullest extent permitted by law, OUTRANKME™ shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our products or services.
OUTRANKME™ total liability shall not exceed the amount paid for the product giving rise to the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless OUTRANKME™, its owners, employees, affiliates, and partners from any claims, damages, losses, costs, or expenses arising from:
Your use of the website or products
Your selected or submitted customizations
Alleged infringement of intellectual property rights
Misrepresentation of military rank, service, or authorization
11. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles.
12. Changes to Terms
OUTRANKME™ reserves the right to update or modify these Terms of Service at any time. Changes will apply to orders placed after the updated effective date.
